Terms and conditions of sale of Gironacci branded bags, belts and wallets

(hereinafter referred to as “Gironacci Pelletterie S.r.l.” or the “Supplier”) sells products marked by the “Gironacci” brand.
These General Conditions of Sale are applicable to all distance sales of Gironacci Pelletterie S.r.l. products on the website www.gironacci.it, including the assistance provided through customer care. Distance sales, as regulated here, have been designed in accordance with current National Laws and the European Directive on consumer rights (no. 2011/83 EU) as an active subject in this system.
The use of the distance selling service described here is reserved exclusively for consumers. The term “Consumer” should be understood as any natural person who concludes a legal transaction for purposes which are predominantly outside of trade, business or profession. It is strictly forbidden to resell, rent or transfer the products purchased on the Site for commercial or professional reasons, in which case the supplier reserves the right to take legal action.
Gironacci Pelletterie S.r.l. can modify these General Conditions of Sale at any time.
These General Conditions of Sale are published on the Site for knowledge, conservation and reproduction by the Customer.
It is understood that, by placing an order on the website https://www.gironacci.it, the Customer fully and unreservedly acknowledges and accepts these General Conditions of Sale.
These General Conditions of Sale do not regulate the supply of services, nor the sale of products by parties other than Gironacci Pelletterie S.r.l, even in cases where they are presented on the official website via links, banners or other hyperlinks . Therefore, before placing an order and/or purchasing products and services from parties other than the Supplier, the Customer is invited to check the conditions of sale applied to it. Under no circumstances can the Supplier be held responsible for the supply of goods and/or services by third parties.
Consult the privacy policy to obtain information on the processing of Customers' personal data.

2. Product orders

Orders can be placed directly by non-incompetent adults. For the purposes of identifying the Customer, reference will be made exclusively to the information provided at the time of purchase. He, therefore, will be considered solely responsible for any false information.
The Customer is required to provide Gironacci Pelletterie S.r.l. a valid e-mail address to which the requested information will be sent, as well as the information concerning these General Conditions of Sale and any order information.
Each distance selling order placed by the Customer covered by these General Conditions of Sale may concern one or more products.
Gironacci Pelletterie S.r.l reserves the right to modify at any time the limits for the quantity and/or types of products that can be purchased through distance selling.
The Customer is responsible for selecting the items of interest. The Customer's cart and the order summary sent to the Customer following completion of the purchase include a description of the products ordered, including measurements and dimensions (where applicable).
Gironacci Pelletterie S.r.l. adopts all appropriate measures to ensure that the photographs on the Site faithfully represent the original products, including the use of technological means to reduce inaccuracies as much as possible. However, some variations are possible due to the technical characteristics of the Customer's computer and colour resolution. Accordingly, any confirmation of the status of a product is subject to the limitation of possibly inaccurate representation on the customer's computer. Gironacci Pelletterie S.r.l. does not guarantee the identity and graphic representation of the products shown on the website with regards to testing, for the technical reasons listed above. In case of discrepancies between the images and the product description, only the latter will prevail.
The Customer must click on the cart icon to view the selected items and the total price of the ordered items. The Customer is invited to check the contents of the cart before completing the purchase form according to the instructions provided on the Website.

3. Product prices

The product prices include all taxes and shipping costs in the countries and territories indicated by the Supplier, unless otherwise specified on the website www.gironacci.it, in the Shipping and Delivery section, or on the order page. The Supplier reserves the right, and the Customer accepts, to vary the shipping costs based on the market conditions.
The price of each product is displayed to the Customer before completing the order. All prices are in euros as established on the website www.gironacci.it or on the order page and include VAT.

4. Completion of the order

The purchase procedure is complete once the Customer confirms the order. Upon confirmation, the order is sent directly to Gironacci Pelletterie S.r.l..
The Customer can correct or cancel the order before completion by leaving the Website without confirming the order.
The General Conditions of Sale are always available on the website www.gironacci.it.
Gironacci Pelletterie S.r.l. considers the Customer's order binding once the entire purchase procedure has been correctly completed, without errors detected by the Site. The contract between Gironacci Pelletterie S.r.l. and the Customer is considered concluded when the Customer receives from Gironacci Pelletterie S.r.l. the confirmation of completion sent in accordance with the purchase procedure to the e-mail address indicated during the order procedure,.
Before sending the confirmation by Gironacci Pelletterie S.r.l. of the positive conclusion of the contract, Gironacci Pelletterie S.r.l. reserves the right to decide whether or not to accept orders which do not provide sufficient guarantees of solvency, which are incomplete or incorrect, or in case in which the products are not available, therefore the Customer's order being considered only as a mere purchase proposal. In this case, Gironacci Pelletterie S.r.l. will inform the Customer that the contract has not been concluded and that it is not following up on the order. The Customer is informed within 30 days of sending the order to Gironacci Pelletterie S.r.l. Any amounts already paid by the Customer for the order will be refunded.
Following the conclusion of the contract, the Customer will receive a written confirmation of the order at the e-mail address indicated, indicating the number and date of purchase, the product ordered, the price and the amount paid.
The Customer can access the order and these General Conditions of Sale in the My Orders section, which also includes the history of past orders, with the possibility to print all these documents.
The Customer can cancel the order via the Gironacci Pelletterie S.r.l. Customer Service, only until the ordered products have been prepared for shipment.

5. Payment conditions

The Customer must make payment using one of the methods indicated in the order form.
In order to prevent internet fraud, payments made via the website www.gironacci.it are processed by Nexi. Payment is carried out on a secure page that uses SSL certificates (Secure Socket Layer), a system that guarantees maximum security for online transactions. Your credit card details are protected from unauthorized access via the SSL encrypted tranfer of data, and is not accessible to third parties.
Gironacci Pelletterie S.r.l. does not charge any fees for payment. However, the customer may be charged fees by their credit institution if they apply.
If, for any reason, the amounts owed by the Customer cannot be debited, the sale procedure and the sale itself are automatically cancelled.
If you buy with Klarna you receive your order immediately and pay in 3 instalments. You acknowledge that the instalments will be assigned to related parties and to their assignees, and that you authorise such assignment.

6. Retention of title

The delivered goods remain the property of Gironacci Pelletterie S.r.l. until full payment has been received.

7. Delivery

After sending the order via the website www.gironacci.it, the Customer can monitor the delivery of the order on My orders.
The Customer can contact Customer Service www.gironacci.it via e-mail and request information on delivery.
The items are delivered to the address indicated by the Customer only after registration of the order payment. Gironacci Pelletterie S.r.l. processes orders within a maximum of 7 working days from receipt of payment, except when Gironacci Pelletterie S.r.l. informs the Customer, within the same deadline, of the non-acceptance of the order, pursuant to the previous article (4) or of particular conditions that prevent compliance with the terms. All delivery options available for your order and their costs will be displayed at checkout.
Delivery terms are purely indicative.
All the shipping costs, including additional costs to be paid by the Customer, are indicated in the order form at the time of purchase on the Gironacci Pelletterie S.r.l. website. Additional shipping costs are not refunded in the event of a change of item or returns.
In the case of shipments to countries outside the European Union, goods may be subject to customs duties or taxes. Any additional taxes for customs clearance will be borne by the recipient. In the case of the goods not being delivered (due to, for example, the recipient having provided the wrong address and/or phone number, or the repeated absence of the recipient at the address provided), or if the goods are not accepted by the customer, the recipient will be charged a fee to cover the following expenses: shipment of the goods + return shipment of the goods + any customs fee for the return of the goods. The cost of the goods themselves will be reimbursed to the customer. Customs duties and taxes are charged when the goods arrive in the country of destination, and the cost varies depending on the country. For further information regarding duties and taxes, and providing for the clearance of goods, we recommend that you contact your local customs office.

8. Warranty

The responsibility of Gironacci Pelletterie S.r.l. for any defective material will be governed by the applicable legal provisions.
Any defects in conformity of the products purchased on www.gironacci.it will be subject to the Legal Guarantee.
The Customer cannot make claims for defective products if these are the result of a modification carried out by the Customer or by a third party, unless the Customer can demonstrate that the defect already existed at the time of delivery.

9. Returns and refunds - Withdrawal

The Customer's right of withdrawal, without penalty and without reason, must be exercised as described below.

The right of withdrawal must be exercised by the Customer within 14 (fourteen) days from the date of delivery to the Customer or third parties.

To exercise the right of withdrawal, the Customer must complete the form on the Return Request page of the website www.gironacci.it.com and obtain a return form which will be sent via e-mail. Once the return form has been obtained, the Customer must print it and insert it in the package together with the products to be returned, and organise for its shipment. It is not possible to request a product exchange, even with another product of equivalent value, if the customer wishes to make an exchange, he must carry out the return procedure and purchase a new product.

In order for the return to be accepted by Gironacci Pelletterie S.r.l., the products must be returned without delay and in any case within 14 (fourteen) days from the date on which the Customer received the product, and respecting the following conditions:

The products must be returned in their original packaging (box, accessories, plugs, protections, information leaflets, etc.).
The products returned by the Customer must not have been damaged, used, worn or washed, but may have been handled and inspected to determine their nature and characteristics.
Damaged goods that are returned must be in the condition in which they were received by the Customer; the Customer must not attempt to modify, manipulate or repair it.

Gironacci Pelletterie S.r.l. reserves the right to refuse the return of products which have been damaged, which are incomplete, deteriorated and/or dirty or in any condition that clearly indicates that the products have been used, as well as any products returned after the deadline indicated above, or without a return form.

Gironacci Pelletterie S.r.l. also reserves the right to request compensation for any damage caused by the negligent or malicious conduct of the Customer at the time of return of the products. Gironacci Pelletterie S.r.l. cannot be held responsible for lost or stolen products outside of its control, or for returns to the wrong address, or for delays in delivery of returned products outside of its control, it being understood that the Customer assumes all risks of the return. The Customer is also required to provide proof of return.

In case of withdrawal, the Customer will be refunded all payments made to Gironacci Pelletterie S.r.l., according to the payment method chosen for the purchase, and for the product for which the withdrawal was exercised, including delivery costs (excluding additional charges for special deliveries described in article 5 above). The only expenses payable by the Buyer, unless otherwise communicated by the Supplier, will be those aimed at returning the goods, which requires the adoption of the precautions previously listed.

Gironacci Pelletterie S.r.l. will refund these amounts upon receipt of the returned product and after having completed the conformity checks of the goods, or when the Customer demonstrates that he has correctly sent the product to Gironacci Pelletterie S.r.l.. Refunds are made with the same method used for payment. Refunds are free for the Customer.

10. Limitation of Liability

Claims for damages by the Customer are excluded, except in the following cases: Claims for compensation resulting from injury to life, body or health or from breach of essential contractual obligations as well as liability for other resulting damages from an intentional or grossly negligent violation of duties by Gironacci Pelletterie S.r.l., its legal representatives or its auxiliaries, as well as other hypotheses provided for by mandatory provisions of law. Relevant contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.
In the event of a breach of essential contractual obligations, the supplier is only liable for foreseeable damages typical of the contract, if these are simply caused by negligence, unless the Customer claims compensation for damages for injury to life, limb body or health.
The limitations set out in paragraphs (1) and (2) also apply to the legal representatives and vicarious agents of the provider, if the claims are asserted directly against them.
The applicable provisions on product liability remain unaffected.

11. Product authenticity, warranties and intellectual property rights

Gironacci Pelletterie S.r.l. guarantees the authenticity and quality of all products sold on the website www.gironacci.it.
The total or partial reproduction, modification or use of designs, models or patents exclusively owned by Gironacci Pelletterie S.r.l. is strictly prohibited.
The buyer is guaranteed the conformity of the goods in the contract within the two-year period established by the Consumer Code.
In the absence of conformity, the Customer may request, alternatively and without charge, the repair or replacement of the purchased goods, or a reduction in the price, or the termination of the contract, unless the request is objectively impossible to be satisfied or excessively onerous, pursuant to the combined provisions of articles. 135 bis - 135 ter of the Consumer Code.
The buyer is required to report the defects without delay from discovery and in any case within the legal deadlines, providing a detailed description of the problems, otherwise the warranty will be forfeited. The report must be sent by registered letter with return receipt, PEC or other traceable communication tool.
Once the complaint has been received, the Supplier, after having carried out the necessary investigations, will authorise or deny the return of the goods by providing a return code, sent to the e-mail address provided with the order confirmation. The authorisation to return the goods does not, however, constitute recognition of the non-conformity, the existence of which will be ascertained only following the inspection by the Supplier.

12. Force majeure

Provision of services by Gironacci Pelletterie S.r.l. may be suspended in the event of unforeseeable circumstances or force majeure which would prevent or delay their execution.
Gironacci Pelletterie S.r.l. will inform the Customer of such unforeseeable circumstance or force majeure as quickly as possible. If the suspension of services lasts more than 15 days, the Customer may cancel the order and receive a refund of the amounts already paid.

13. Privacy

The Customer can always have information on how Gironacci Pelletterie S.r.l. processes personal data in our Privacy Policy.
Pursuant to art. 12 Legislative Decree 70/2003 and articles. 50 - 51 of the Consumer Code, the buyer is informed that each order sent online will be stored and archived in digital and/or paper format, with suitable guarantees of confidentiality.
The buyer is invited to archive both the order receipt and the order confirmation appropriately.

14. Out-of-court resolution of disputes

As per EU Regulation 524/2013, the Purchaser is informed of the right to refer to the resolution of any dispute with the Supplier to institutions, companies, offices active in alternative dispute resolution available on the following website https://eur-lex.europa.eu/legal-content/IT/TXT/PDF/?uri=CELEX:32016R0679&from=IT

15. Competent jurisdiction and applicable law

The General Conditions, as well as any non-contractual obligation deriving from them or relating to them, are governed by the rules of Italian law and must be interpreted on the basis of it (with the exclusion of the rules relating to private international law); the application of the mandatory rules of the Customer's place of residence remains unaffected. All disputes deriving from, or relating to, the General Conditions or any non-contractual obligation deriving from them or relating to them, will be resolved exclusively by the Italian courts or by the courts of the Customer's place of residence if required by a mandatory rule established by applicable law.

In case of discrepancy between the General Conditions of Sale in Italian and in another language accepted by the Customer, the meaning and interpretation of the General Conditions of Sale in Italian will prevail.
